Acceptance of terms

By downloading, installing, or using SMS IQ ("the App"), you agree to these Terms of Use and to the Privacy Policy, which is incorporated here by reference. If you don't agree, don't use the App.

The service

SMS IQ is an Android messaging app that can act as your default SMS/MMS app, offering local message organization, AI-assisted categorization and replies, custom automation rules, and optional cloud AI and webhook integrations. Features, quotas, and pricing may change over time as described in these terms.

Eligibility & license

You must be able to form a binding contract in your jurisdiction to use SMS IQ. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal or internal use. You may not reverse engineer, decompile, resell, sublicense, or use the App to build a competing product, except to the extent applicable law gives you a right you can't waive.

Acting as your SMS app

If you set SMS IQ as your default SMS app, it takes over receiving, storing, and (at your direction) sending SMS/MMS on your device. You are responsible for the content of messages you send, and for any carrier charges, message failures, or delivery delays that result from your carrier, network conditions, or device state (e.g. airplane mode, no signal) — these are outside the App's control. Scheduled messages fire based on your device's clock and battery/OS behavior (e.g. Doze mode); we make a best effort to re-arm them after a reboot but can't guarantee delivery at the exact scheduled instant on every device.

AI features

SMS IQ's AI features — categorization, summaries, suggested replies, and field extraction — are generated automatically, either by an on-device model or, if you opt in, by SMS IQ Cloud. AI output can be wrong, incomplete, or misleading. You are responsible for reviewing AI-generated content before relying on it or acting on it, especially for anything with financial, legal, medical, or safety consequences. Do not treat AI output as professional advice.

Your automations & webhooks

SMS IQ lets you configure automation rules that forward message data to a destination URL you choose — a webhook. This is a powerful feature, and with it comes responsibility that sits with you, not us:

• We deliver the payload to the URL you provided. We do not audit, monitor, or vouch for third-party endpoints you point SMS IQ at.
• You should only send data to endpoints you trust, that you have the right to send that data to, and that use a secure connection (HTTPS). We are not liable for interception, misuse, leakage, or loss of data at or after your chosen destination, including due to a compromised, misconfigured, or malicious endpoint.
• Authentication secrets you type into a webhook's configuration are encrypted at rest on your device (see Privacy Policy §5), but that protection ends once the secret is used to authenticate a request to your endpoint — from there, its security depends on the endpoint you chose.
• If your automation forwards data belonging to other people (e.g. senders who texted you), you are responsible for having any consent or legal basis required in your jurisdiction to forward that data to your chosen third party.
• We may throttle, retry, or disable a webhook rule that fails repeatedly, is used to violate §8 (Acceptable use), or that a destination provider reports as abusive.

Subscriptions & purchases

• Paid plans and addon packs are sold and billed through Google Play Billing and governed by Google Play's own terms, including auto-renewal, cancellation, and refund policies.
• Subscriptions renew automatically at the then-current price until you cancel through the Play Store; cancellation takes effect at the end of the current billing period.
• Refunds are handled by Google Play under its refund policy — we do not process refunds directly.
• Free-tier daily AI quotas reset on a rolling basis and may be changed at any time; addon-pack credits, once granted, do not expire unless stated otherwise at time of purchase.
• We do not guarantee uninterrupted availability of paid features and are not liable for temporary quota, billing-verification, or service outages.

Acceptable use

You agree not to use SMS IQ to:

• Send unsolicited bulk messages, spam, phishing, or fraudulent content, or otherwise violate applicable telecom/anti-spam law (e.g. TCPA or your local equivalent) in the messages you send.
• Monitor, forward, or extract another person's messages via automations without the legal right or consent required to do so.
• Attempt to circumvent, abuse, or excessively load SMS IQ Cloud's quota system, App Check/anti-abuse protections, or billing verification.
• Use the App for any unlawful purpose, or in a way that infringes the rights of, or harasses, any third party.
• Reverse engineer, tamper with, or interfere with the App's operation or its backend services.

We may suspend or terminate access to cloud-dependent features (SMS IQ Cloud, webhooks, billing) for accounts/devices found violating this section.

Third-party services

SMS IQ relies on third-party services — Google Play Services and Billing, Firebase (App Check, Installations, Analytics, Cloud Functions), Google AdMob, and one or more AI/language-model providers behind SMS IQ Cloud — each governed by its own terms and privacy practices. We are not responsible for the availability, performance, or policies of these third parties, or for changes they make, including a change of AI provider behind SMS IQ Cloud as described in §5.

Intellectual property

The App, its design, code, and branding are owned by the developer of SMS IQ and protected by applicable intellectual property laws. You retain all rights to your own message content and data; using the App does not transfer any ownership of your data to us.

Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the App (including AI output, message delivery, or webhook delivery) will be accurate, uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, the developer of SMS IQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of the App — including, without limitation, data sent to a webhook endpoint you configured, reliance on AI-generated output, or a change in cloud AI provider. Our total aggregate liability for any claim relating to the App will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

Indemnification

You agree to indemnify and hold harmless the developer of SMS IQ from any claim, loss, or expense (including reasonable legal fees) arising from your use of the App, your automation/webhook configurations, the messages you send, or your violation of these terms or applicable law.

Termination

You may stop using the App and uninstall it at any time. We may suspend or terminate your access to cloud-dependent features for violation of these terms, suspected fraud or abuse, or if required by law. Sections that by their nature should survive termination (e.g. §10–13) will survive.

Changes

We may update these terms as the App evolves. We'll update the "Effective" date above when we do; continuing to use the App after a change means you accept the revised terms. If a change is material, we'll make a reasonable effort to surface it in-app.

Governing law

These terms are governed by the laws of [insert your governing jurisdiction, e.g. India], without regard to its conflict-of-law principles, and any dispute will be subject to the exclusive jurisdiction of the courts located there, except where applicable consumer-protection law in your own country of residence grants you a right to bring a claim locally that cannot be waived.
